End User License Agreement

1. Acceptance of Terms

This End User License Agreement ("Agreement") is a legal agreement between you ("User," "you," or "your") and StoryMuse ("Company," "we," "us," or "our") for the use of the StoryMuse creative writing platform and related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, do not use the Service.

2. Description of Service

StoryMuse is an AI-powered creative writing platform designed to assist novelists, screenwriters, and storytellers in developing their creative works. The Service includes:

• AI-assisted writing and brainstorming tools
• Story organization and management features
• Character and world-building tools
• Export functionality for various formats
• Cloud storage for your projects

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Your Content and Intellectual Property

By using the Service, you grant us a limited, non-exclusive license to:

• Store and process your content to provide the Service
• Create backups of your content for data protection purposes
• Display your content back to you through the Service interface

We do not claim ownership of your content, and we will not use your creative works for any purpose other than providing the Service to you, unless you explicitly authorize such use.

5. AI-Generated Content

The Service uses artificial intelligence to generate suggestions, text, and other content. You acknowledge and agree that:

• AI-generated content is provided as suggestions and creative assistance only
• You are responsible for reviewing, editing, and approving any AI-generated content before use
• AI outputs may occasionally be inaccurate, inappropriate, or not suited to your needs
• You retain full creative control and responsibility for your final work
• We make no guarantees about the originality or copyright status of AI-generated suggestions

You are solely responsible for ensuring that your use of any AI-generated content complies with applicable laws and does not infringe on the rights of others.

6. Acceptable Use

You agree not to use the Service to:

• Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate content that exploits minors in any way
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service for any commercial purpose not expressly permitted
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems or software to extract data from the Service

We reserve the right to suspend or terminate your account if you violate these terms.

7. Subscription and Payment

Certain features of the Service may require a paid subscription. If you purchase a subscription:

• You agree to pay all applicable fees as described at the time of purchase
• Subscriptions will automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Refunds are provided in accordance with our refund policy
• We reserve the right to change pricing with reasonable notice

8. Privacy

We strive to provide reliable service, but we do not guarantee that the Service will be available at all times or without interruption. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time

• Update features, functionality, and user interface

We will make reasonable efforts to notify you of significant changes that may affect your use of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORYMUSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless StoryMuse and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your use of the Service
• Your violation of this Agreement
• Your violation of any rights of another party
• Your content or creative works

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and associated data after a reasonable period
• You may request an export of your content before termination takes effect

You may terminate your account at any time by contacting us or using the account deletion feature if available.

14. Changes to This Agreement

We reserve the right to modify this Agreement at any time. We will notify you of material changes by posting the updated Agreement on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the modified Agreement.

15. Governing Law and Disputes

This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from this Agreement or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. General Provisions

• Entire Agreement: This Agreement constitutes the entire agreement between you and StoryMuse regarding the Service.
• Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer this Agreement without our prior written consent.
